End user license agreement.

01The agreement

This End User License Agreement (the “Agreement”) is between you and JCAM, Inc. (“snipes,” “we,” “us”). It governs your use of the snipes mobile application and any related services we provide (together, the “App”).

By installing, opening, or using the App, you agree to this Agreement and to our Community Guidelines and Privacy Policy, which are incorporated here by reference. If you don’t agree, don’t use the App.

02Who can use snipes

• You must be at least 18 years old to broadcast on snipes. You confirm this at signup.
• You must be at least 13 years old to watch on snipes.
• You must have the legal capacity to enter into this Agreement under the laws of your country.
• You must not be located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist-supporting” country, and you must not appear on any U.S. Government list of prohibited or restricted parties.

If we discover you don’t meet these requirements, we will terminate your access.

03License to use the app

snipes grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on Apple-branded devices you own or control, solely for your personal, non-commercial use, in accordance with the Usage Rules of the Apple App Store Terms of Service.

You may not: (i) copy, modify, distribute, sell, or lease any part of the App; (ii) reverse-engineer, decompile, or attempt to extract source code, except where applicable law expressly permits; (iii) use the App to build a competing service; (iv) use bots, scrapers, or automated means to access the App; or (v) circumvent any security, rate-limit, or moderation system.

04Your content

“Your Content” means anything you broadcast, post, or otherwise transmit through the App — live video, recorded video, comments, captions, reports, anything else.

You retain ownership of Your Content. You grant snipes a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for technical purposes such as transcoding), display, distribute, and otherwise use Your Content for the purpose of operating, improving, and promoting the App. This license ends when you delete Your Content, except where retention is required by law or where Your Content has been shared with others who haven’t deleted it.

You represent and warrant that: (i) you own or have all rights needed to share Your Content; (ii) every person identifiable in Your Content has given consent to be filmed and broadcast; (iii) Your Content does not infringe any third party’s rights; and (iv) Your Content complies with this Agreement and the Community Guidelines.

05Zero tolerance

You agree not to broadcast, post, or otherwise transmit any content that:

• Depicts a minor (anyone under 18) as a recognizable subject;
• Contains nudity, sexual acts, or sexualized framing of any person;
• Depicts weapons used as threats, violence, fighting, or threats of violence against any person or group;
• Depicts illegal drug use, sale, or distribution;
• Films a person who has not consented to being filmed, or films inside any space where a person has a reasonable expectation of privacy (bathrooms, change rooms, residences, medical settings, and similar);
• Harasses, bullies, intimidates, or targets any individual or group;
• Depicts self-harm, suicide, or content that promotes either;
• Is otherwise illegal under the laws that apply to you or to snipes.

The list above is not exhaustive. Our Community Guidelines spell out the rules in plain language; this section is the legally binding version.

06Moderation, reports, and blocking

snipes moderates the App as follows:

Filtering

Every active live stream is sampled in real time by automated content-safety models. Content flagged as likely to violate this Agreement is routed to human reviewers for immediate action, which may include ending the live stream.

Reporting

Any user can report any stream or comment from inside the App: tap the ··· menu on a stream or long-press a comment, then choose Report. Reports involving privacy violations or minors get priority routing. You can also email jay@snipes.world directly.

Response time

We act on every report within 24 hours. A 24/7 on-call moderation team reviews reports, removes content that violates this Agreement, and ejects the user who provided it. Action against the offending account may include warning, temporary suspension, or permanent device-level ban, in proportion to the severity of the violation.

Blocking

Any user can block any other user. A blocked user cannot comment on your streams, appear in your view of the App, or be shown your activity. Blocking is one-tap from any user’s handle in the App.

07Privacy

Our Privacy Policy describes what we collect, how we use it, and your rights. By using the App you also agree to that policy. snipes is an anonymous-identity platform — we do not require your name, email, or any persistent personal identifier, and we do not provide cross-device account recovery.

08Termination and device bans

You may stop using the App at any time by uninstalling it. You may request deletion of any content you have stored in the App by emailing jay@snipes.world.

We may suspend or terminate your access to the App at any time, with or without notice, for any reason — including any violation of this Agreement. We may ban the device associated with the offending behavior, in addition to or instead of the handle. Device bans are designed to survive reinstallation; creating a new handle on a banned device will not restore access.

Sections that by their nature should survive termination (license to content already shared, intellectual property, disclaimers, limitation of liability, general provisions) will survive.

09Intellectual property

The App, the snipes name and logo, and all software, designs, and content we provide are owned by JCAM, Inc. or our licensors and are protected by intellectual property laws. We grant you only the license stated in Section 3.

If you believe content on the App infringes your copyright, send a DMCA notice to jay@snipes.world with the information required by 17 U.S.C. § 512(c)(3).

10Disclaimers

The App is provided “as is” and “as available,” without warranty of any kind, express or implied. To the maximum extent permitted by law, snipes disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

snipes does not warrant that the App will be error-free, secure, or available without interruption, and does not warrant that content shared through the App will be accurate, lawful, or free of objectionable material despite our moderation efforts.

11Limitation of liability

To the maximum extent permitted by law, snipes will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the App.

snipes’s total cumulative liability to you for all claims arising out of or relating to this Agreement or the App will not exceed the greater of (a) the amount you have paid snipes in the twelve months before the claim arose, or (b) one hundred US dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the provisions above apply only to the extent permitted by law.

12Apple-specific terms

You and snipes acknowledge that this Agreement is between you and snipes only, and not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content.

The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules of the Apple App Store Terms of Service.

Apple has no obligation to provide any maintenance and support services with respect to the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

snipes, and not Apple, is responsible for addressing any claims relating to the App or your possession and use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, snipes, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

13General

Changes to this Agreement

We may update this Agreement from time to time. Material changes will be surfaced in the App; the effective date at the top of this page will be updated. Continued use of the App after a change means you accept the updated Agreement.

Governing law

This Agreement is governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The exclusive jurisdiction for any dispute is the state and federal courts located in New Castle County, Delaware, except where applicable law gives you the right to bring proceedings in your local courts.

Severability

If any provision of this Agreement is held unenforceable, the remainder will continue in full force and effect.

Entire agreement

This Agreement, together with the Community Guidelines and Privacy Policy, is the entire agreement between you and snipes regarding the App and supersedes any prior agreements.

Assignment

You may not assign this Agreement. snipes may assign it to an affiliate or in connection with a merger, acquisition, or sale of assets.
